Overview

The unit introduces you to the legal framework within which individual employment relations operate in Malaysia and Australia. Topics include important workplace relations issues like the rights and duties underpinning the contract of employment, unfair dismissal, constructive dismissal, discrimination and occupational health and safety law. Selected International Labour Organisation Conventions are analysed in relation to aspects of current employment protection law and policy.

Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per semester typically comprising a mixture of scheduled learning activities and independent study. Independent study may include associated readings, assessment and preparation for scheduled activities. The unit requires on average three/four hours of scheduled activities per week. Scheduled activities may include a combination of teacher directed learning, peer directed learning and online engagement.

The main purpose of this module is to examine employment law and human resource management issues through a comparative approach, with Australia and Malaysia as contrasts. You are not expected to master both the employment law in Malaysia and Australia respectively. However, you should be able to identify different practices between the two jurisdictions, and where applicable, explore the reasons for such distinct approaches. It is important to take note that history, culture and political ethos impact on the development of employment law. Thus, you should not approach employment law in isolation of the socio-economic and political trends around them. Assessment tasks include a case analysis, where you are required to critically analyse an unabridged court judgment and answer the questions posed.
