Overview
This unit examines current issues in transnational dispute resolution. As such, the content of the unit may
vary each time it is offered. However, it is anticipated that the unit will canvass, from a comparative
perspective, the effective, expeditious and cost-effective application of both binding and consensual
dispute resolution mechanisms in international commercial disputes. This is likely to include a detailed
consideration of the processes and procedures of international commercial arbitration (as administered by
leading arbitral institutions in London, Paris, New York, Singapore and Hong Kong); an overview of the
activities of leading commercial and international commercial courts; and, the enforcement of the product
of key dispute resolution processes, including awards, judgments and mediated settlement agreements.

dispute resolution in both an Australian and international context. - 2
Research, identify and apply contextual information and theoretical approaches to the
understanding of dispute resolution at both a national and trans-national level. - 3
Work effectively within a team environment, to plan, manage and deliver a persuasive
collaborative response to a specified problem or topic. - 4
Critically analyse the application and limitations of laws related to commercial arbitration,
mediation and dispute resolution in a range of contexts. - 5
Synthesise knowledge from a broad range of relevant sources in order to formulate appropriate
responses, both verbally and in writing, to complex problems arising in transnational dispute
resolution.

24 contact hours per semester (either intensive or semi-intensive, depending on the Faculty resources, timetabling and requirements). Students will be expected to do reading set for class, and to undertake additional research and reading applicable to a 6 credit point unit.
