Australian migration law

The central focus of the unit is to equip you to prepare submissions to various bodies/institutions including the Department of Home Affairs, the Administrative Review Tribunal (ART) and the Courts. The unit is principally designed around the life cycle of the process of a visa application. 

The Migration Act 1958 (Cth) is the prime area of study for this unit. The unit will contextualise the law and policy which drives migration law. It will then look at the design of the various regulatory instruments which govern the area. The most common visa applications will be examined being the family/spouse, work/skilled and student categories. It will also look at humanitarian visas which apply to refugees. The cancellation of visas which can lead to deportation will be looked at and crucially the appeal process. The procedural as well as the substantive aspects of the visa application process will be examined.
