For Legal Studies students (L4004, L5004, L6013) you must have completed LAW5000 or LAW5081.
Juris Doctor students (L6005) who commenced their course in or before 2026 must have completed a minimum of 72 credit points of study.
Juris Doctor students (L6005) who commenced their course in 2027 or later must have completed a minimum of 60 credit points of study.
Overview
Democratic governance rests on a foundational premise: that public power is held in trust and must be exercised for the public good. Yet across the globe — in mature democracies and emerging states alike — that trust is routinely tested, subverted, and broken. Corruption, electoral manipulation, the abuse of incumbency, the capture of regulatory institutions, and the weaponisation of law itself against democratic norms represent some of the most consequential legal and governance challenges of the contemporary era.
The Law of Politics and Corruption examines the legal frameworks that regulate political life and the ways in which those frameworks succeed or fail in constraining corrupt and anti-democratic conduct. Drawing on public law, international law, and comparative constitutional law, you will develop an integrated understanding of how legal systems define, detect, and respond to corruption in its many forms — from the bribery of public officials to the systemic capture of state institutions by private interests.
By the end of this unit, you will be equipped to critically evaluate anti-corruption legal frameworks; advise government, civil society, and international organisations on law reform; and engage with the scholarly debates at the intersection of law, politics, and institutional design. The unit is relevant to lawyers working in public law, compliance, international development, human rights, and governance — and to anyone committed to understanding how law can be both a tool of power and a check upon it.
